Wow!! will they shut down YouTube in that state. Just think a photo of b o "could get up to a year in jail and $2,500 in fines." ;D ;D as a "image that could "frighten, intimidate or cause emotional distress" to anyone who views it.
~snip~
After criminalizing the shared use of Netflix accounts (http://venturebeat.com/2011/06/02/tennessee-web-entertainment-theft-bill/), Tennessee law makers continued to demonstrate their misunderstanding of the internet by passing a law that makes it illegal to post offensive images online.
The law makes it a crime to "transmit or display an image" that could "frighten, intimidate or cause emotional distress" to anyone who views it — which is about as ridiculous as making it illegal to open your eyes for fear of seeing something you don't like.

I'm a TN gal, but I have no explanation for this one. We have had some good legislation put forth lately, but this one is a poser. :o
What offends or "frightens" one person may not bother another. So how do you determine the guidelines for this? ???

OUCH!!!!!
That one is painful to the eyeballs!
The way I see it, Tennessee is dumb to do what they're doing, but it can't really be "unconstitutional" because the Constitution applies only to the federal government. One would have to look to the Tennessee state constitution. I'm sure they have one... somewhere.
I'm almost possitive it's unconstitutional, all States have their own variations of the Bill of rights, usually going further or expanding on the original 10 Amendments.
But States Rights aside, I'm pretty sure thought crime falls under the bill of Rights. ;)

Sorry about that, should have put a content warning adult also.
If you REALLY want to post offensive images, try a Tennessee family reunion shot.

If not, it should get you assault charges.
You just assaulted me with an offensive pic of a dead person. :cheesy:
