That's tangential to its validity.  Einstein's theory is widely considered the among most successful and encompassing models in the history of science, but by your inability to understand basic terminology it's fraudulent.  Germ theory is the foundation of all modern medicine and yet you clearly have a problem with the phrase. 

Do you understand that scientific theories are models that explain observed evidence, and not "guesses"?  The colloquial usage of the phrase has no relevance to official denotation.
