Title: Frivolous ADA lawsuits-a light of hope.
Post by: Solars Toy on April 21, 2012, 08:33:02 AM
One of our local Assemblywomen here in California is proposing a new bill to fight against frivolous ADA lawsuits here in California.  I will admit I voted for this woman and have met her personally.  She is quite a little fireball.  I am following this bill and hope it passes.

She put together a fact sheet to better understand what it is suppose to do.  Basically it gives the business 120 days to correct or start the correction before any lawsuit can be filed.  Also it would require a court or jury to consider any previous or pending lawsuits filed by this individual for the same or similar issue.

I believe it is a step in the right direction.  I have included the link to the fact sheet which is a quick one page read.

Yeah, the problem with this is that it is just a further complication of the system.  As an analogy, take a look at the tax code.  We have a several-thousand page tax code and then it'll be like "oh, let's exempt [action x] from taxes by slapping on thirteen more pages."  The reality of "reform" should be to burn the rules to the ground.  And I mean that in a non-anarchist manner.  In other words, when did it get to the point where every time we want to do something, it's a new legislation?  How about rescinding laws totally and then cheering for that?  Not amending them with additional attachments and legal language and making things more complicated?  How about get rid of the ADA?  Did anyone ever think about that?  No, right?  We'd all scream bloody murder if that was proposed.
