Using laugh-out-loud justification, Justice Department lawyers have asserted to a federal judge that Hillary Clinton should be trsuted to decide what records she chooses to delete, with no outside review. Ruby Kramer of Buzzfeed is correct: a brief filed by Justice Department attorneys on Wednesday, was "little-noticed." Yet it contains a shocking position for federal lawyers to assert to a court.

Department of Justice lawyers outlined a comprehensive defense of the contentious decision by Hillary Clinton to wipe the private email server she used as secretary of state: The attorneys assert that, regardless of whether she used a personal or government account, Clinton was within her legal right to handpick the emails that qualified as federal records — and to delete the ones she deemed personal.

So their strategy is to ignore the real question which is why was she using a private server in the first place? Seems risky, let's see if the judge is dumb enough to fall for it.

This judge is the one over the judicial watch lawsuit! I don't think he will buy this argument! This was in response to his last order requiring more E-mail info. This federal judge does not play if he thinks he is being stonewalled. He has a past history of appointing special prosecutors to go after the justice dept. for hiding evidence from his court (Steveens case). He will come up with something creative!! :popcorn: :popcorn:

When The Des Moines Register asked her about the latest twist in the private server saga on Tuesday, she said she had no new answers.

Just before Clinton sat down for a 105-minute meeting with the Register's editorial board, the Washington Post posted a news story that said the State Department's request for her emails was "prompted entirely by the discovery that Clinton had exclusively used a private e-mail system."

That contradicts what Clinton has been saying, which is that agency officials asked her for her emails as part of a benign, general record-keeping effort to sweep up "everything from other secretaries of state, not just me," as she said Sunday.

After the editorial board meeting, a Register reporter asked Clinton if she could explain the discrepancy between her characterization of why she turned over the emails and the State Department's.

"I don't know that. I can't answer that," Clinton answered. "All I know is that they sent the same letter to everybody. That's my understanding."
