Southern California City Bans Smoking and Vaping in Apartments, Condos

Starting next year, smoking or vaping inside apartments, condos, or other multi-family housing in Carlsbad, Calif., will be illegal, the city council decided Aug. 20.

In a 4–1 vote Tuesday, city leaders approved a smoke-free ordinance for multi-unit housing in the coastal city of 115,000 people, about 35 miles north of San Diego.

The new law, which will go into effect Jan. 1, 2025, covers all smoking and vaping, including marijuana used for recreational and medical purposes.

Although medical marijuana is legal in California, the city can prohibit its use in some places, according to Carlsbad City Attorney Cindie McMahon.

"The Americans with Disabilities Act (ADA) and its state counterpart do not require a reasonable accommodation for anything that poses a health and safety risk to other parties," McMahon said at Tuesday's council meeting.

The city expects landlords and property management companies to enforce the new rules by including them in future lease contracts instead of the city hiring more code enforcement or police officers to respond to citizen complaints.

With all these lawyers with cameras on the street I'm shocked we have so much crime in the world.
This challenge to law and order is always the start to loosing our constitutional rights.
How come nobody was interested in educating people about these rights until online videos got monetization?

Ever since the debut of vaping, all I see is vape shops everywhere. We have gone from bad to worse. Cigarettes butts supposedly disintegrate, but a vape tube doesn't. We went from inhaling tar to inhaling artificial chemicals. That's not good. I usually get pissed off at the "truth" commercials that claim that there is cigarette advertisements in the hood is because it is racist. I hate that. Cigarette companies are not racists. They will gladly sell white people Marlboro's or Winston's and as they would sell black people Newport's or Kool's.

They want us to smoke, so they can make a profit. And, we are dumb enough to spend $6 to $12 a pack every time we stop at the corner store. That is piss-poor money management. No wonder we stay broke, and become unhealthy in the process.

Just a little tidbit: when you rent or lease, you down own shit. That is not your apartment or condo, nor your car or truck. You are just paying for the privilege of sleeping or driving somewhere. If it were cheaper to live in a hotel, I would. You would have to deal with less extra shit (utilities, entertainment/internet) but get extra shit (maid service). However, renting a storage unit to house your excess shit (that you do not want to part with) is expensive.

As for owning the property, you can keep that. Too many assholes stink up your property with smoke that never goes away, burning holes in the carpet or furniture provided, or worse burning down a building because they are nothing but plywood palaces. It takes an act of God to evict someone or get your money back. Just look at the squatting problem.

Why are you complaining about the West Coast? We all know California is a left-wing Mecca. Why are you surprised? You live there.

Again, YOU DON'T OWN THAT APARTMENT! It's just a place to sleep. I can't make any changes to the apartment. I can't knock down a wall and have a one large bedroom or have a kitchen window to the living room. You eat, sleep, work repeat. That's it.

I wonder how many of those apartments already had no smoking policies in place to begin with. To me, it seems like it is a waste of government resources. Maybe, if somebody is breaking into you home, you can dial 911 and tell them someone is smoking as they are kicking in your door.

So all of a sudden the land owner is the victim? WTF is wrong with you?
As the owner you take on risks, be it fire or malicious vandalism and make it a part of doing business.
Insurance goes up, expenses go up, you raise the rent based on what the Mkt will bare.
There are also laws regarding the repainting of a rental, after a few years, you as the owner are responsible to repaint the domicile, or if you have a content renter you may be off the hook till they leave, at which point you are obligated to repaint before a new tenant moves in.
It all falls under the "Cleaning Deposit" fee.

If I want to rent to smokers only, should that not be my prerogative as the land owner, and if someone wants to rent there because say, they are old farts like me who like a quieter lifestyle sitting on their deck having a cigar, shouldn't anyone be allowed to rent there as well?

This is why a lot of people choose HOA's over no rules for their community. The choice is yours, more Karens breathing down your back snitching you out, or none at all?

Exactly! I hate the smell of cigarettes myself, I also hate bad BBQ's and smug liberals, so I live where I live, so as to limit my exposure to the things I despise.

HOA's have their place, but unfortunately we get examples of them overstepping their boundaries. Take the fact that they are put on blast on news media and social media all the time and it seems like that is happening 100% of the time. If I worked on an HOA, I would never tell someone they couldn't park their pickup on their own driveway. I would never tell a nurse she couldn't ride her motorcycle to a patient's home. But, I understand the optics of living in an HOA: for every busy-body HOA person, there is a boundary-pushing resident. People want to live in a white picket fence community, and you have some jerk going overboard with an ugly fence made from painted old bicycles. And, since I can't afford housing, nor the HOA fees if they are required, I will live how I have to live. The price of rent to too damn high.

You live in California. The state completely banning smoking is the LEAST of your worries. Hopefully, you are not stupid enough to get into the renting business. With squatters and delinquent renters having more rights than the property owners, spouting your rights doesn't mean squat. The leftists favor criminals and criminal behavior over the public. Hopefully, you have the common sense to to avoid that investment. You have judges ruling in favor of the squatters, and home owners being arrested for trying to get their homes back.
