Maybe Billy can clarify this, but when I went through training, it was pounded into my head, that detainment IS ARREST!
It was explained this way.
When you impede the Right of an individual to go about their personal business, the court views this as an arrest, despite you having let them go, it is the detainment in itself that blurs the line and can get you sued in civil proceedings.

Technically THE COURTS determine when arrest takes place, so actually it is a gray area. Between full custodial arrest and a brief detention It depends on what the officers intention is and if there is "PROBABLE CAUSE" or reasonable suspicion, big difference. Also THE AMOUNT OF FORCE YOU CAN USE IS A FACTOR, put cuffs on somebody or Manhandle them and its an arrest.

But stopping people under suspicious circumstances a BRIEF reasonable time period to determine if there is PC for an arrest is common place. Used to do it all the time, stop some creeper, run his name through NCIC/WALES for warrants let him go or find a gun on him and it becomes "an arrest" but if you stop somebody and let him go you go to do a report or a FI card (field interoggation) All that was required by the judicial system.

Of course this is Switzerland the reason for his "detention" is unclear, did he cross a barricade or a police line to secure area? Or are they just Messing with him coz they don't like the political slant of his Media?

If they were here, and black, there'd be an investigation and police would have been fired.
But you're right, it's Swiss, so nothing will come of it, considering Swiss being interchangeable with Sheep.
