Q PATRIOT!!!

Bronx

People sleep peacefully at night because there are a few tough men prepared to do violence on their behalf.

A foolish man complains about his torn pockets.

A wise man uses it to scratch his balls.

So he is basically saying the Supreme Court of the United States is no longer Supreme?
Wow.

This took me by surprise especially since Carhartt main customers are the all American blue collar, Red, White, And Blue workers.

It's great to see you hears posting.

No, that's not what he's saying.

Carhartt is a family-owned privately-held company with extensive operations in the US and Mexico. The company's US factories are unionized. The Biden/OSHA mandate would certainly have affected Carhartt, had it been put into effect. But removing that mandate does not necessarily mean much in a case like Carhartt.

Companies like Carhartt are not currently proscribed from instituting their own company-specific vaccine requirements. In cooperation with the unions that represent the company's workers, Carhartt has done that. Many other companies have climbed on the vax-wagon. Carhartt joins the ranks of the usual suspects, like Google, Facebook, Twitter, and Microsoft, all of whom have internal employee vaccine mandates. But others include McDonald's, Goldman-Sachs, Citigroup, Walmart, The Walt Disney Companies, United Airlines, Tyson Foods, Saks, Ford Motor Company, American Express, and many more.

General Electric recently made unexpected (and welcome!) news when it recognized the SCOTUS decision on the OSHA mandate by scrapping its company-wide vax policy. I expect that reaction will be rare.

The Biden/OSHA vax mandate was quite narrow in its scope, and it was overturned because the Supreme Court recognized that Congress had never authorized OSHA to do anything of the kind. But the court can only stop the federal government from mandating shots. State and local governments and private businesses are generally out of the court's reach.

Bull-Pluckey.
Take out the word "shots" and insert "school segregation" instead.  That means in the 1960's when the Supreme Court mandated integration of the races in schools, all the states had to say was, "No. We will not recognize nor enforce your Supreme Court ruling at the state level.  The state rules in favor of segregation.  The Supreme Court can go peddle their wares elsewhere.

Racial segregation was a case where the so-called "Supremacy Clause" enabled the court to reach down to state level to help evolve national behavior to align more truly with the specifics and the principles of the Constitution. Such cases are pretty rare.

In the recent OSHA mandate case, the court ruled on a federal regulation incorrectly put into place by a federal agency. That's as far as it went, and legally that's about as far as it can go, especially since that was the limit of the case before the court. SCOTUS did not offer a blanket decision on vax mandates in general, nor were they asked to do so. The very same day, in the same session, the same justices refused to stay the CMS vax mandate, which is fashioned much differently.

In the decision regarding the OSHA case, the court vacated the OSHA mandate exclusively. Nothing in that ruling affects any other part of the government, or any state, locality, or citizen.

So, Why was the "Supremacy Clause" applicable with forced integration, but not applicable with forced vacinations?

Reminds me of when I was a child.  I HATED peas.  Mom would serve mixed vegetables and although I was barely able to hold a spoon I was able to pick out the peas and hide them under the rim of the plate.

Supreme Court rulings, take what you like and pick out the parts you don't like?
I'm not comfortable with this.
