Federal lawsuit contends transgenderism is a mental disorder

A Friday story from Reuters highlights a federal district court's decision to proceed with a lawsuit from Kate Lynn Blatt – a man who imagines himself a woman – who claims that he has been discriminated against by his employer under the Americans with Disabilities Act because of his condition:

But U.S. District Judge Joseph Leeson avoided ruling on the constitutionality of the ADA, as the plaintiffs had sought, under the legal principle that courts should avoid decisions on constitutional grounds if possible. Being transgender is not considered a disorder by the American Psychiatric Association [APA], but it can give rise to gender dysphoria, a type of anxiety that may require medical treatment. Gender dysphoria forms Blatt's basis for making a claim under the ADA. Leeson, from the Eastern District of Pennsylvania, found that simply being transgender would be insufficient to bring a case, but that gender dysphoria was a medical condition worthy of protection against discrimination.

According to an amicus brief from GLAD – a Massachusetts-based LGBT legal nonprofit – the explicit exclusion of "gender identity disorder" language in the 1990 version of the current law constitutes a violation of trans peoples' constitutional rights. And that the "updated diagnosis of gender dysphoria (GD) in fact falls outside the scope of that exclusion as defined in the law," implying that the law should be rewritten by judges as medical opinions shift.

This is where the rhetoric around the issue of transgenderism and employment law gets incredibly muddled.........

No offense to you MsIndie ... you are demonstrating the continued imbalanced focus of the mainstream. I'm weary of seeing this small segment of the population addressed. Can we switch to some other part of the population like, let's say, widows, orphans, and poor.

Let me simplify LGBT for the entire world. Lesbian, Gay, Bisexual, and Transgender ... are simply bad choices. And the fact that it messes with the heads of those who choose is not surprising. Therefore, you can call it a mental disorder if you like - but I'm sure that label creates an opening for taxpayer dollars to be spent ... and we have too many other more central aspects to address ... like the poor, widows, and orphans.

Actually, gays and lesbians were once considered mentally ill and then the psychiatric community decided that it wasn't a mental disorder.  I'm actually glad to see that once again those in the LGTB community are considered have a mental illness.  These people need some help.  What I find infuriating is that health insurers will pay for the operations...these people need mental help, not gender reassignment surgery.

If classified as an illness, it potential gets coverage from insurance under mandate - you and I pay for treatment.

The problem is that the working class keeps paying for the bad choices of others and there's not enough help to go around. Drug abuse, alcohol abuse, pornographic abuse, child abuse. sexual perversion ... you get the idea. And the second order affects are broken families and kids without parents who can teach them to be responsible, civil, contributing adults who are content to work and live under law and within their means. There is only so much human and financial resource to go around and a focus on those who find themselves poor not to their own fault, orphans, and widows. These should be classes that almost anyone should be able to get behind ... I would think.

Those with minority sexual identity issues, abuses, or those who choose to contribute can band together and fund health pools that want to work in those areas. That would be a choice they can make. But I would make a different choice and would not contribute to these ... would rather choose to contribute to reduce poverty and brokenness of those who are truly in the helpless fringes.

Bad choices?  They are mentally unstable.  People don't chose to be mentally unstable.  Insurance should cover mental illness NOT gender reassignment surgery.

Chicken or the egg? There is some disposition for any of our weaknesses which you could label a mental instability if you want to ... and it's our choice whether to fight against it or give in to it. After succumbing for a time, it becomes nearly impossible to overcome by ourselves - we defend it and try to rationalize it. So it is a choice to follow our tendency.

What is really terrible is when those who rationalize their perversion as normal and then teach it to our children ... and pull some of them toward their weaknesses.
