Obama officials made clear in a press briefing that firms would not be allowed to lay off workers to get into the preferred class of those businesses with 50 to 99 employees. How will the feds know what employers were thinking when hiring and firing? Simple. Firms will be required to certify to the IRS – under penalty of perjury – that ObamaCare was not a motivating factor in their staffing decisions. To avoid ObamaCare costs you must swear that you are not trying to avoid ObamaCare costs. You can duck the law, but only if you promise not to say so.

There is something definitely surreal about a government which forces small businesses to lay people off and then commit themselves to perjury by not telling that truth in any follow-up report. I'm torn between comparing this to Kafka or to something out of "Catch-22."

I wonder if it is written into the law? If not it is ripe for a lawsuit based on the First Amendment.

There's already ~1000 possible lawsuits out there, and nobody doing jack schite to make any of it happen.

Why do we care that # 1001 is possible.......and will never happen ?

Virtually every word of ACA should be tied up in court, and completely paralyzed by injunctions against implementation.

But.................not.   WTF is going on........

Andy, you're looking right at it but not seeing it. This is an excellent example of "death by a thousand cuts," sometimes called creeping normality. Good metaphors include the camel's nose under the tent flap and the frog slowly coming to a boil. The Left has mastered the technique and it is the essence of the Democrat approach to KenyaCare -- "We'll have to pass the bill to find out what's in it." They knew that exposing the entire scheme at once would be instant political suicide, and they've been relying on the drip-drip-drip approach for going on five years to get this Frankenstein monster woven into the fabric of the nation.
