Village of Dolton's bid to acquire Pope Leo XIV's childhood home could face legal hurdles
A fight for ownership of Pope Leo XIV's childhood home in Dolton, Illinois, raises questions about legality. The current owner of the home at 212 E. 141st Pl. has signaled that he plans to sell it at auction, and Dolton Mayor Jason House has said the village will seek to buy it, but if negotiations fail, could seek to acquire it through eminent domain.

The home had been listed for less than $250,000 for only a matter of days before Pope Leo's historic election was announced. It was put up for sale on May 5 for $245,957.

But hours after the new pope's name was announced, the home was quickly removed from the market as the owner worked to determine his next steps, according to realtor Steve Budzik.

"At first I didn't really like believe it," Budzik said. "I didn't really believe because I didn't see the news."
...

The home was last purchased in May 2024 for $66,000 and Buczik said the new owner had planned to flip it, but became unsure after learning the news.

So now, under eminent domain, no one will get anything.
The city will align the price to that of the minimum selling homes and screw everyone.

Watch the news, the homeowner will resort to burning his own property for the insurance.

I dunno.  The fair market value of the house is now pretty high.

I think the govt is supposed to pay fair market value. If offers are made that would be good evidence of that.
BUT the threat of govt taking would depress the value.

I recall there was a SCOTUS case that broadened the concept of public use.IMO it sucked.

Yeah, I know what Govt is supposed to do, but this will wind up in court in spite of what SCOTUS said.
Scotus stated it was also for economic development. Seizing one house out of thousands can hardly be seen as "economic development".
You have to admit, this is a stretch where stealing private property for heritage reasons falls under the guise of economic development.
I've no doubt they initially get away with it, but lose in the end.
