Is Communism Legal in the United States?
In 1954, President Dwight Eisenhower signed the Communist Control Act of 1954. The law explicitly outlaws the Communist Party of the United States. It also criminalizes membership in the party or support of the party in any way. The act also further criminalized anyone who supported communist organizations or actions in any way.

The law was intended to be incredibly broad to make it a bit easier to prosecute people who were supporting such organizations. Because anti-communism sentiment faded at the end of the Cold War, this law is not discussed nearly as often as it once was, but it is still on the books today.

Why Was the Communist Control Act of 1954 Passed?
The Communist Control Act of 1954 was created and passed during a time known as the Red Scare in the United States. The Red Scare refers to a time when a lot of people were very nervous that their friends, family members, and neighbors could secretly be communists or could be communist spies. The goal was to prevent the influence of international espionage that was being undertaken by international communists.

Many people opposed communism on the principle that it was the main form of government in the USSR, and many people believed that the goal of Communism was to undermine democracy. Therefore, democracy and communism could not both exist, and the Communist Control Act of 1954 was passed.

Did Anyone Oppose the Communist Control Act of 1954?
In the 1950s, the Cold War was at one of its peaks. There were a lot of people who were scared about the prospect of nuclear war, and many people were in agreement that communism was a threat to democracy everywhere.

On the other hand, there are some people who opposed the Communist Control Act of 1954. J. Edgar Hoover opposed the Communist Control Act of 1954. He hunted communists effectively, but he was vehemently opposed to the Communist Control Act of 1954 because he was afraid that it would force the communist movement in the United States underground. Therefore, it would be much harder for him to track their movements.

Law reviews at the time also felt the act was rushed and politically charged. As a result, the Michigan Law Review and the Yale Law Journal both said the law's wording was vague and unclear. This would make it both hard to enforce and potentially unconstitutional.

Is There a Communist Party in the United States Today?
Even though this law is still on the books, there is a communist party in the United States today. It is incredibly small and it has next to no influence, so the political system in the United States has decided not to prosecute members.

Furthermore, there are some court cases that have been reviewed during the past few decades that have decided that it would be illegal to keep the communist party off the ballot. Even though communist candidates have never won anything significant, there is technically a communist party in the United States. There has not been any discussion of repealing the Communist Control Act of 1954.

New leader of New York Communist Party was aide to AOC

A senior official within the New York State Communist Party has been revealed to be the former aide to socialist Congresswoman Alexandria Ocasio-Cortez, (D-NY).

According to The New York Post, Justine Medina, 33, earned $35,000 working for the 'Squad' member's 2020 campaign.

IMHO, I do not see even this current SCOTUS allowing this law to stand if it is ever brought up before the court. Where as I do not think this law violates American rights near as much as what DeSantis pulled on Disney.
 Do you think other steps could be taken first. Ex. we need to teach and inform the people what communism really is, the crimes, the violence, the mass killings.
Or, could it be pushed that it is way past time to hold any group, communist, BLM, antifa, liable to the destruction they cause. Why do people not go to jail when businesses are destroyed in riots? If everyone in a bank robbery can be charged with murder even if only one pulled the trigger, why do we not hold all rioters liable for the destruction the riot caused. It could almost be argued that is what the democrats did on Jan.6th
Here is a wild ass guess, if this law were to be enforced, I would not be surprised to the the democrat party change their name to socialist democrats, as a way to stop the enforcement.

Here's how I saw it back in the day. The threat to the world was real, we as Americans felt a duty to keep the world free of oppression by global dictators, that was a kind of given.

Fast forward to today, and that evil is us, our very own govt using deception an war as a tool.
The govt literally took a play from the establishments RINO handbook, they prop up both sides in a conflict they created, then play the, "Join us, unless you want your enemy to win" card.

Literally the same shit we saw every election here, support the RINO, or you get stuck with the Dim.
But I digress.
After having read much of Durham's report, it's become blatantly obvious Communism is afoot in the DNC, anyway, that's their end goal.
Now here's the tricky part and Trump can use it to make serious change in this country.

It will take a master and I think he can do it. Paint the left in the image they are, expose who and what they intended, their connection at the hip with the NWO, and how they've used our govt to suppress freedoms globally, including the weaponization of the CCP Flu.

Once we start incarcerating these commies, we can start pushing this great law back into the forefront/practice and cementing it in the minds of the younger generation, just how they were lied to and used by an actual Communist insurrection.
Once the Nation sees the truth and we start a mass movement to the right, we will be gin to see a rapid healing.
