I don't see this as much of a win; certainly common sense did not prevail. The Branch Covidians come away with a clean victory on the CMS mandate, which is very likely to cripple hospitals nationwide. Note how happy Peppermint Psaki was to announce that bit of news.

On my home front, Mrs. Tbone will be devastated when she learns about this. She volunteers at a local community center that is largely funded by our hospital, and she adores her "job." But even as an unpaid volunteer completely removed from actual medical care (she helps distribute low-cost meals to seniors at non-hospital locations), she has already been notified that she will fall under the CMS mandate. I helped her put together an application for exemption based on religious grounds, but I'm certain hospital bigwigs have delayed decisions on such things until SCOTUS spoke. While the possibility of a religious exemption still exists, there is not longer the slightest advantage to recognizing one.

Perhaps the greatest irony is that this decision comes when the Omicron variant has essentially turned the benefit of being vaxxed on its head. Proponents are now reduced to the unsupported claim that the vaccines somehow attenuate the effects of the disease, a proposition they can't prove and will likely never be proven. Caseloads are skyrocketing, it's true. But nobody is dying.

I can tell you exactly what  happened. The 6 who voted against the  corona  shot  mandate didnt want to give Biden 2 defeats so they gave  on a  victory  on the  lesser  case that effects fewer  people.

I haven't taken the thing apart, but the arguments were bound to be sharply different.

With OSHA, it's just a clear sneaky-pete end around. Biden's handlers knew the mandate was illegal from the get go, but decided to take it in the teeth at a later date in exchange for a few months of bullying hundreds of employers to toe the line. To a depressingly large extent, it worked. Reminds me of the old saw about how much easier it is to ask forgiveness later than to gain permission beforehand. After all, no one is being punished; there was never a down side to breaking the law.

With CMS, it's quite a bit different. OSHA is a straight-up regulatory agency, just a bunch of finger-waggers who write rules and dole out fines. But through Medicare and Medicaid, CMS doles out big money by the boatload. It's the kind of money that literally keeps a lot of smaller hospitals and clinics in business, and offers a magnificent enhancement to the bottom lines of many others. So CMS could play the same role so many other federal agencies have in the past.

Remember the so-called nationwide 55 mph speed limit? There was no such thing. But there was a Federal Highway Administration holding billions in highway funds hostage until every state finally okayed it. Remember the national drinking age being raised to 21? Same agency, same bullshit. Recall the series of "Dear Colleague" letters put out by the Department of Education regarding Title IX rules and procedures? They were blatantly illegal too, but DofEd had the money, and you were free to take your college in some other direction.... if you could afford to do without Uncle Sam's sugar tit.

I dont understand on what legal logic they can deny the one mandate but allow the other? Its really like the SC has just become another legislative body who considers not just the law as they are supposed to, but also considers the political and economic ramifications of their rulings. Not at all how the founders intended it to be.

We handed them the keys. Over a hundred years ago, the American people permitted the national government to institute an income tax with no upper limit, and allowed the formation of a central bank empowered to set fiscal and monetary policy.

OSHA is a bare-bones regulatory agency, not charged with passing out money, but rather with regulating business with regard to worker health and safety. That agency's vax mandate was ridiculous to begin with, and far beyond any reasonable interpretation of what Congress meant for it to do.

The CMS mandate is different because it involves an agency that actively hands out hundreds of billions of tax dollars every year. CMS is the source of Medicare and Medicaid payments. Unlike OSHA, CMS is in a position to be able to use its disbursements as leverage, insisting on compliance by means of threatening to withhold future payments.

I know it sounds an awful lot like what the cop shows would call extortion or blackmail. It sounds that way because that's pretty much what it is.

This is not a new thing. The government did the same thing back in the 1970s, using Federal Highway Administration money as muscle to get the states to lower their speed limits to 55. They pulled the same trick some years later, using the same agency, to con the states into raising their drinking ages to a universal 21. More recently, the Department of Education, which has become the majority source of funding for an astounding number of colleges, has deployed a similar tactic to get schools to comply with Title IX "suggestions" and "guidances" contained in so-called "Dear Colleague" letters.

It all goes back to 1913 and the first great American "Progressive" upheaval.
