I have been thinking about how the GOP should proceed as the confirmation process unfolds. There is a potential trap for the GOP if they go all out against any nominee. The main reason is the reality that the democrats have the numbers in the senate and the nominee will be confirmed. It doesn't matter how radical she will be. Let us not forget democrats have no shame.

I believe the approach should be a thorough background check. Then question the nominee professionally, but very deeply. Don't delay the process and give the democrats material to energize the base. Basically, take the medicine and get back to exposing the Biden administration for its incompetence.

The bottom line is there is no change in the math. It is still 6-3.

Exactly. No one Biden can nominate is likely to be any worse than Breyer has been. I can't remember a single important case when he hasn't been part of the monolithic left-bloc vote.

Breyer has never been a judicial treasure. He has always been an activist, just as Sotomayor, just as Kagan, just as RBG was.

During the recent arguments over the OSHA vaccine mandate, it was almost hilarious to read the questions and comments made by the Triage TrioTM. Despite the fact that these people are legally and technically Supreme Court Justices, they seem to have no interest in the law or the Constitution. They were selected for exactly that reason. Their questions and comments never even touched on constitutional or legal issues; it was all about the "feelz."

The alleged president will appoint a new justice selected for racist, sexist, and ideological reasons. That is his choice, but it's our choice to call him out at every opportunity. The man has a history of sixty years of racism and sexism. (Sorry about the "man.") The ideology comes from his handlers; it's far beyond his capabilities.
