Pi**ed Off Re: VA Income Tax Delay

Received an unsigned letter dated March 23rd from the Commonwealth of Virginia titled "Review Of Tax Return".  It states my joint tax return has been selected for review in an effort to reduce the risk of identity theft and tax fraud. In a condensation of the text, if I have yet to file, tell them, If I have filed and have yet to receive an refund I have to give them additional information. The third condition was if I've already received my refund ignore the letter. The letter asks for a clear copy of my 1099 form and my phone number.

Income tax form was mailed late February. The address used on the tax return has been unchanged for 28 years. Copy of the 1099 was stapled to the state tax return. Being a stubborn SOB, I'm thinking of telling them my phone number and refusing to supply any further information. 1099's have social security numbers on them and on the outside chance that this is phissing I don't want to give out that information.

I'm considering asking them on what authority do they have the right to suspend my request for a tax refund. What is their legal basis? The letter doesn't quote any legal authority.

I will say they may have a suspicion in that I've been late in filing for a tax refunds for the past three successive years. The due date is April and I wasn't filing federal and state returns till late May. There isn't a penalty for filing late for refunds.

Call them. If they are legit, they'll know what your talking about and explain it.

Why they need your 1099 is curious. 1099's are not filed or attached with your return, at least they aren't in CA.
