The Michigan Supreme Court is overwhelmingly conservative. Their decision seems inevitable.

Good.

Good.

Memory is hazy on when the female-mutilation bill was signed, or which Michigan governor signed it, but I strongly suspect it's over a decade old, and enough time to survive challenges --- which come only now, from someone the feds have so securely in their net.

Let's say my religion involves screwing with federal government. How long d'you think I'd get to hold services --- out of jail? Their "religion" butchers children. How long should THEY remain free?

Ah, I thought the law was passed recently. Looks like they might be nailed to a tree.

Good.

Good.

I just found this, posted May 17.

Quote
Felony charges for female genital mutilation in Michigan would be tougher than current federal law under legislation passed unanimously through the state Senate Wednesday.

Performing or coordinating female genital mutilation procedures is already a federal felony carrying penalties of up to five years in prison and a $250,000 fine.

But two sponsors of the bills, Sens. Rick Jones, R-Grand Ledge, and Margaret O'Brien, R-Portage, were inspired to make it a state felony carrying a maximum of 15 years behind bars after Detroit-area doctor Jumana Nagarwala was accused of performing female genital mutilation on two minors.

"When I first heard of this practice taking place in Michigan, I was shocked," Jones said on the Senate floor. "I could not believe something so evil, so horrific, so demonic could happen here in Michigan."

http://www.mlive.com/news/index.ssf/2017/05/tougher_penalties_for_genital.html

Oh yeah. Notice how they avoid mentioning it's Muslims who do this barbaric act upon their daughters.

Quote
Female genital mutilation has existed for centuries and involves removal of portions of or the entirety of a woman's labia or clitoris, usually performed between the ages of 6 and 9, according to prosecutors.

The bills -- SB 337, SB 338, SB 368 and SB 369 -- now head to the House for consideration.

My information was bad. The federal law is about five years old. This is what these alleged parents are being prosecuted under.

There is presently no Michigan law although a pair of anti-Sharia bills were approved May 21 by the state senate and are en route to the House.

If they're being prosecuted under the present federal law by the current DoJ the results should still be good...I think I have that right.

Any road, I believe every state needs female genitalia mutilation laws.

Federals? Anything's possible. Anything.

These hotheads exceeded their brief. I do agree every state needs such a law, BUT.....

The present state-level move is a barn-door action which will probably be struck down by 6th Circuit appellate judges reminding us states may not pass laws more restrictive than the feds.

Getting spineless federal-level Republicans to pass a 15-year-penalty? Foh-GIT-it! Islam is our friennnnnnnnnd!

That's not true. State law and Fed law can be two different things, Fed law does not trump state law in all cases, especially where the fed has no business ruling. The state can file this under several statutes like malpractice, Fed, on the other hand has other options, but the Fed can't yank this out of the hands of the state, it's still a states issue.
The Fed may decide to charge her and the state may allow it, or she may face both State and Federal charges, but the Fed does not have power over the state in cases such as this, unless it's being charged under First Amendment restrictions, remember the Bill of Rights?

This is going to be a minefield for any prosecutor, Fed or State, the State just might want to let the Fed have this as it's a serious hot potato, one straight from the microwave, explodes when you open it.

I agree it's a minefield. Some lunatic judge might believe Islam is actually a religion, that a barbaric death cult actually deserves to practice horrors like this.

This thing is like an onion as it unfolds. I'm not going to bet either way on any freedom-of-religion issues. What I'd *LIKE* involves ten feet of stout rope and any place to anchor it --- tree limb, lamp post, doorjamb, you name it. That is prohibited by my state's law, so go figure.

The "doctor" remains in jail without bond. That's some consolation, the pace that any federal case goes (particularly in the early stages before what I expect will be a jury trial). Even a couple of years awaiting trial is still better than letting her on the street.

Onion is a good analogy, because each layer removed, gets her closer to exoneration. I say that only because the enemy has learned to use our laws against us.

A federal prosecutor claimed yesterday that up to 100 girls were mutilated by these animals.

Quote
“Due to the secretive nature of this procedure, we are unlikely to ever know how many children were cut by Dr. (Jumana) Nagarwala,” Woodward said, referring to the lead defendant in the case, later adding, “The Minnesota victims were not the first victims.”

Against Woodward’s wishes, U.S. District Judge Bernard Friedman granted bond to two other defendants in the case: Dr. Fakhruddin Attar, 53, of Farmington Hills, who is accused of letting Nagarwala use his clinic to perform genital cutting procedures on minor girls; and his wife, Farida Attar, 50, who is accused of holding the girls’ hands during the procedure to keep them from squirming and to calm them.

The government believes the three defendants, all members of a local Indian-Muslim sect, subjected numerous girls to genital cutting procedures over a 12-year period. To date, the government says it has identified eight victims — including the two Minnesota girls — though Woodward said the government estimates there could be as many as 100 victims. She said that’s a conservative estimate, and that it’s based on Dr. Attar’s alleged admission to authorities that he let Nagarwala use his clinic up to six times a year to treat children for genital rashes.

That many "genital rashes" must be so commonplace in Islam that there's no need to call in Child Protective Services....right?

Detroit – A Farmington Hills-based mosque paid a physician to perform female genital mutilation, a lawyer for the doctor’s children alleged in court Tuesday.

Cynthia Nunez, an attorney for the Michigan Children’s Law Center who represents two children of Dr. Jumana Nagarwala, said the physician was paid to cut girls as part of a procedure practiced by their religious and cultural community, the Dawoodi Bohra.

The counter-claim is that the doctor WAS paid, all right --- for food bought for the mosque's food bank, like 2-liter pop, etc., etc.

Here's the liberal Detroit Free Press version. It's the first I've seen there, after this issue broke.

I wonder what will happen, when some lunatic "religion", practicing human sacrifice, demands recognition. Perhaps some Mexicans will demand to be allow to practice the Aztec "old time religion". I sure that they could find some mentally unstable suicidal individual willing to demand that his/her heart be ripped from his/her chest
