Dallas salon owner who refused to close sentenced to 7 days in jail, ordered to pay fines

A Dallas salon owner who has continued offering services despite a citation, cease-and-desist letter and a restraining order was sentenced on Monday to seven days in jail.

In Tuesday afternoon's hearing, Dallas Civil District Judge Eric Moyé also ordered her to pay thousands in fines for refusing to shut down her salon in violation of shelter in place orders.

Salon a la Mode owner Shelley Luther reopened on April 30 even though the state has required non-essential businesses to close in response to the coronavirus pandemic. Gov. Greg Abbott announced Tuesday that salons will be allowed to reopen Friday.

The judge heard testimony from a Dallas code inspector and a Dallas police officer who both testified they saw clients inside the salon getting haircuts and manicures over the last seven days despite Moyé's rulings.

City attorneys argued Luther willfully and flagrantly violated Judge Moyé's order.

With the backing of the Republican governor, the Texas attorney general is urging a Dallas judge to free a salon owner he jailed Tuesday after she refused to apologize for keeping her business open in violation of the governor's coronavirus order.

The office of Attorney General Ken Paxton told Dallas County State District Judge Eric Moyé in a letter that he abused his discretion when he "unjustly jailed" Shelly Luther for seven days, Fox News reported.

In a tweet, Paxton said Luther "should immediately be released from jail."

"Locking her up is a misguided abuse of power, especially considering Dallas County released real criminals to 'protect them from COVID-19,'" he wrote.


A GoFundMe campaign has been launched on Luther's behalf, with some $290,000 already donated.

Texas Attorney General Ken Paxton has called for the "immediate release" of a Dallas salon owner who was arrested and sent to jail for opening her business in defiance of Gov. Greg Abbott's stay-at-home orders.

Shelley Luther, owner of Salon A La Mode, was sentenced to seven days in jail Tuesday after Dallas judge Eric Moye said she violated those orders as the coronavirus pandemic continues.

Paxton said he believes the judge is abusing his authority and that her arrest seems like a "political stunt." In a full statement, Paxton said:

"I find it outrageous and out of touch that during this national pandemic, a judge, in a county that actually released hardened criminals for fear of contracting COVID-19, would jail a mother for operating her hair salon in an attempt to put food on her family's table," said Attorney General Paxton. "The trial judge did not need to lock up Shelley Luther. His order is a shameful abuse of judicial discretion, which seems like another political stunt in Dallas. He should release Ms. Luther immediately."

The attorney general sent a letter to Moye, saying her sentencing was "significantly overbroad." He mentioned that Abbott's new executive order will allow her to operate business starting on Friday.

This post is a good example of shallow analysis, perhaps exacerbated by some confirmation bias.  To get a more complete and useful picture for a comparison, you would have to cross-reference a number of factors that affect spread and mortality rates including population density and the trends for new cases and deaths.  For goodness sake, where we are now is not where we are going to be.

Take the US and Belgium, for example.  Belgium has 720 deaths per million, the US 226.  Is the US doing better?  Yes, so far.  This site has data by country, and if you look at the Belgium projections you will see that Belgium peaked around April 12th for deaths, and has dropped considerably since.  https://www.worldometers.info/coronavirus/country/belgium/
The U.S. peak so far was on May 1st, more than two weeks later, and is only gradually falling.  We may not yet have reached the middle of woods, whereas Belgium pretty clearly is on its way out.

Daily new cases has fallen dramatically in Belgium, but is more or less consistent in the States.  Both the UK and the US do not look good in this respect.

The U.S. has 94 people/sq.mile, Belgium has 383, over 4x more.  The UK is 259.  In a heavily urban environment the virus will spread so much faster, especially when you can be an asymptomatic carrier.  As for the culpability of the health care system, it depends on how it is managed.  If you get swamped you get swamped.  No one was really prepared for this pandemic.

The administration has done an abysmal job handling Covid-19, in almost every respect.  Solar began this thread on Jan 21st, and the White House knew Covid-19 was going to be a big problem well before that.

Officials in Ventura County, California will be expanding coronavirus testing, tracking the infected and those who they've been in contact with, and moving people out of their homes and into specialized housing for COVID-19 patients.

Discussing the need to hire contact tracers and manage active cases, Ventura County Public Health Director Dr. Robert Levin said during a May 4 press conference that people who live in homes where they could expose family members to COVID-19 would be moved into 'other kinds of housing' provided by the county.

"We also realize that as we find more contacts, some of the people we find are going to have trouble being isolated," said Levin. "For instance, if they live in a home where there is only one bathroom and there are three or four other people living there, and those people don't have COVID infection, we're not going to be able to keep the person in that home.

Every person who we're isolating, for instance, needs to have their own bathroom. And so we'll be moving people like this into other kinds of housing that we have available."

The Trump administration has shelved a document created by the nation's top disease investigators with step-by-step advice to local authorities on how and when to reopen restaurants and other public places during the still-raging coronavirus outbreak.

The 17-page report by a Centers for Disease Control and Prevention team, titled "Guidance for Implementing the Opening Up America Again Framework," was researched and written to help faith leaders, business owners, educators and state and local officials as they begin to reopen.

It was supposed to be published last Friday, but agency scientists were told the guidance "would never see the light of day," according to a CDC official. The official was not authorized to talk to reporters and spoke to The Associated Press on the condition of anonymity.

The AP obtained a copy from a second federal official who was not authorized to release it. The guidance was described in AP stories last week, prior to the White House decision to shelve it.

Rational? Science?   Is there any such animal anymore?  LOL   No.   The amount of over estimation, scaring the populace with 'models', past history of gleefully awaiting catastrophe upon the US and its people. And having lived a bit with some recognition of what has happened in the past, makes me more than a tad suspicious of this whole thing.

INSULTING is it?  Insulting to those suffering and dying, and taking great risks for everyone's benefit.   PERHAPS if the states had recognized those at greatest risk they would not have placed covid patients INSIDE nursing home facilities...and perhaps they would  not have allowed covid 19 positive workers to continue to 'serve' inside those same nursing homes, then we wouldn't have had the death count that the elderly warehouse have been exposed.  I'm probably not gonna provide you with a link on these two referenced actions.  You ought to know about them if you're paying attention.

and you know what else might have helped...that those nurses and doctors and aides not taken the time to choreograph and video their dance moves and skits for the public while their patients ARE DYING.
