Exclusive: White House preparing draft national emergency order, has identified $7 billion for wall

Washington (CNN)The White House is preparing a draft proclamation for President Donald Trump to declare a national emergency along the southern border and has identified more than $7 billion in potential funds for his signature border wall should he go that route, according to internal documents reviewed by CNN.

Trump has not ruled out using his authority to declare a national emergency and direct the Defense Department to construct a border wall as Congress and the White House fight over a deal to end the government shutdown. But while Trump's advisers remain divided on the issue, the White House has been moving forward with alternative plans that would bypass Congress.
"The massive amount of aliens who unlawfully enter the United States each day is a direct threat to the safety and security of our nation and constitutes a national emergency," a draft of a presidential proclamation reads.
"Now, therefore, I, Donald J. Trump, by the authority vested in me by the Constitution and the laws of the United States of America, including the National Emergencies Act (50 U.S.C 1601, et seq.), hereby declare that a national emergency exists at the southern border of the United States," the draft adds.
The draft was updated as recently as last week, a US government official told CNN.

According to options being considered, the administration could pull: $681 million from Treasury forfeiture funds, $3.6 billion in military construction, $3 billion in Pentagon civil works funds, and $200 million in Department of Homeland Security funds, the official said.
As lawmakers discussed a short-term measure to fund the government Thursday, Trump again raised the prospect of other ways to fund a border wall without congressional approval.
"I have other alternatives if I have to and I'll use those alternatives if I have to," he told reporters.
"A lot of people who wants this to happen. The military wants this to happen. This is a virtual invasion of our country," Trump said.
The Defense Department referred a request for comment from CNN to the White House.
If the declaration is made, the US Army Corps of Engineers would be deployed to construct the wall, some of which could be built on private property and would therefore require the administration to seize the land, which is permitted if it's for public use.

But before everyone comes down hard on President Trump, let’s take a look at some of the “national emergencies” declared by Daddy Bush, Bubba Clinton, Globalist George, and Comrade Barry;

Daddy Bush – Executive Order 12775—Prohibiting Certain Transactions With Respect to Haiti. Really… a national emergency?
 

 
Hubba Bubba – Executive Order 13088 of June 9, 1998-Blocking Property of the Governments of the Federal Republic of Yugoslavia (Serbia and Montenegro), the Republic of Serbia, and the Republic of Montenegro, and Prohibiting New Investment in the Republic of Serbia in Response to the Situation in Kosovo. I never knew Serbia and Montenegro was such a threat.

Bubba, Part II – Executive Order 13194—Prohibiting the Importation of Rough Diamonds From Sierra Leone. “I did not have rough sex with a stripper named Diamond.”

Georgie Porgie – Executive Order 13396-Blocking Property of Certain Persons Contributing to the Conflict in Côte d’Ivoire. Other than officially adopting the official name of their country in French, I’m still wondering what the Ivory Coast did to piss off Mr. Sellout.

Bathhouse Barry – Executive Order 13667-Blocking Property of Certain Persons Contributing to the Conflict in the Central African Republic. Is it just me, or is there quite a bit of dog-piling on black African nations?

Barry, Part II – Executive Order 13664-Blocking Property of Certain Persons With Respect to South Sudan. With the mainly Christian nation of South Sudan fighting a war against the Islamic Republic of Sudan, not once did Obama even bother to name the true aggressors. Then again, Obama couldn’t even bring himself say the words “Islamic Terrorism.”

I wonder why Trump doesn't just declare a national emergency and be done with it, hmmm.

The national emergency is the only bullet in his gun and there is a great chance that it's a blank. No recent "national emergency" has required mobilization of the army and such great expenditure of funds.  It will be tied up in court for years (why wasn't this an emergency in 2017, 2018 or January of 2019 for that matter? Why aren't border congressman supporting this?) on the merits, then face endless eminent domain challenges from people who dont want their land taken etc. 

Once he's fired that bullet all of Congress will happily wash their hands of this and go on their merry way. Trump is going to have to compromise (if he can, he hasn't shown the ability to think that way yet.) half a loaf is all he's going to get. Border security funds, and a little piece if wall.

There's no doubt it'll be challenged, but again, Trump has set up a pretty good defense prior, that, and no doubt it would be fast tracked to SCOTUS, where, again, he will win.
Obozo declared a NE in Africa and no one even blinked and eye when in fact it turned out to be a huge boondoggle.

Trump is going out of his way to follow the Law, follow established proceedure and Constitutional protocols unlike the Keyan with his phone and Pen that kept cranking out EXO's, many of which created these dire conditions that clearly contribute to the ongoing problems surrouding illegal immigration. He knows, unlike Obamao, his actions will end up in court no matter what. Then of course there is the PR war which is all one sided, the fake news will hammer him no matter what. And since it WILL End up in court he must show that he exhausted every means available to rectify the problem and is using this emergecy as a last resort in view of exigent circumstances. These criminal laden caravans should do nicely for "exigent circumstances'.

And no, it will not be tied up in court for years and years, it will be settled rather quickly by the SCOTUS. there are two other Bullets in the gun also. One is to declare Martial Law within five miles of the border, militarize it and have the Army Corps of engineers build "fortifications" around the encampment of Troops tasked with protecting the border.

And the courts have no say so at all re Martial Law.

Second, a complete shutdown of ALL border traffic which is more of a tactical or rather strategic "shut down" of the border traffic, ie certain access points are closed and traffic is "rerouted", due to lack of manpower and proper equipment needed to process entrants. An example of this would be in Texas all Vehicular border traffic enter Only thru El Paso. LEGAL foot traffic thru one other centrally located point.

Last, one has to really wonder WHY the Dems are so opposed to border security including a Wall which most of them were in favor of previously, I don;t think it is just Anti Trump either, if it were me, I'd be checking certain Dems offshore bank accounts and dummy shell corps that are contributing to the DC "war Chest".
