Michigan has first genital-mutilation case

In the wake of an historic genital mutilation prosecution in Detroit, two Senate bills were formally introduced in Lansing today to outlaw the practice of genital cutting in Michigan, which is one of more than 20 states that does not have such a law on the books.

Under the proposed legislation, female genital mutilation would be considered a felony in Michigan, punishable by up to 15 years in prison. That's a much stiffer penalty than what the 1996 federal genital mutilation law calls for, which is five years.  If the bills becomes law, Michigan would join at least 24 other states that have passed anti-genital cutting laws over the last two decades.

It seems to me that FGM would already qualify as "felonious assault."

Keep us informed as to where the democrats in MI come down on this.

I haven't seen any PARTISAN Dems talking about this (except the senators making grandstand moves while also saying a law they intend to pass will somehow apply to an event in the past). Had that tactic worked on other things, we'd have no taxes and no need for senators, but who's noticing, hey.....

CAIR is silent. They would be, although the overtly religious Mussies aren't exactly screaming for Dr. Clippy's release, no matter what her shyster says is a violation of her "religious freedom."

Indictments have been handed down and a trial date will probably be set late this month or early next, if my hunch is right. Usually takes a while for the persecution to mount its offence and the lying shysters to manufacture a defense.

Unfortunately there are several local Detroit issues bubbling: disgraced former mayor Coleman Young's son is running for mayor and his own family's against it, backing someone else. This instantly sets up the hottest local election in decades and is sure to dominate the News or the Free Press until Junior's either in office or jail like his old man fully deserved.

Then there's the summer sports season when Detroiters get bone brain stupid and focus on just sports. I say this from 50 years of watching these knuckledraggers in action.

This is a background item (and opinion piece from a virulently left-wing viewpoint) regarding the absence of a formal U.S. Attorney in the same district which will probably hear this case. Note that the writer and all judges he mentions are black, and also note that McQuade was white and yet instituted the first civil right division within a U.S. District Court.

McQuade (a Democrat) was understandably mouthing the dictates of the runaway racist Hussein, yet she was also fearless enough to jail corrupt Detroit mayor Kwame Kilpatrick and others in what I frankly had thought would favor black defendants. The number of racial-percentage employees in her shop doesn't matter if she's impartial-enough and honest enough to withstand the incredible local pressure to get Jar-Jar Bling-Bling off on all charges.

As a lifelong committed conservative, I am not just mouthing pleasantries in saying, any Dem that honest is worth retaining. But McQuade got dumped when Trump came in, and that is how that stuff does go.

Anti-muslim sentiment runs high enough in "Day-twah," as it is. The prospect for a quiet trial are absolutely out of the question. TV trucks are posted at that U.S. District Courthouse, and have been every day this last week (according to my wife, who was serving on a trial there).

Ripples in the legal pond. Take the kids away from the parents who knowingly subject the child or children to this barbaric practice...

QuoteSt. Paul, Minn. — Lawmakers in Minnesota and Texas are pushing to crack down on parents involved with genital cutting after an indictment against a Detroit-area doctor accused of performing the procedure on two young Minnesota girls highlighted the little-known practice.

Dr. Jumana Nagarwala is charged with female genital mutilation, conspiracy and other crimes. Prosecutors say Nagarwala performed the illegal procedure on two 7-year-old girls at a clinic in February and that the girls were brought to Michigan by their mothers. A clinic manager and his wife who are members of the same Muslim religious sect have also been charged. Nagarwala's attorney has said she was merely performing a harmless religious ritual.

In Minnesota, a Republican lawmaker has offered a bill that could strip custody from parents who knowingly allow their children to be subjected to genital cutting. A Texas Senate committee recently passed similar legislation that clarifies religious or cultural rituals are not an acceptable defense.

(. . . ) In Michigan, prosecutors are relying on federal law to charge Nagarwala, clinic manager Dr. Fakhruddin Attar and Attar's wife, Farida. State Sen. Patrick Colbeck introduced legislation this week that would make the practice a state felony. His bill doesn't address parents.

This says one of the Minnesota victims has been released back to her parent-savages.

So Muslim women are bringing their daughters
to a female Muslim doctor to have their clitorises removed.
Quite a case of Stockholm syndrome -
captives being brainwashed by their captors.
Abuse to the extent of mutilation is so central to Muslim culture
that even the female victims are perfectly fine with it!

It's already a federal crime to mutilate girls this way, plus,
states are passing laws with harsher penalties than federal law.
I wonder how long it will be before the Muzzies wage a lawfare offensive
claiming that the long accepted practice of circumcision
is a precedent that justifies what Muslims do to girls.

The difference is of course that circumcision
removes a mostly non-functional piece of skin,
(and results in lower incidence of some diseases)
where the Muslim practice
removes the primary sensing organ of a girl's genitals.

You'd think Walker would admit when she's not just wrong but tragically wrong. Buried in this same piece is Germaine Greer trying to downplay FGM, and some bizarre comparisons between female genital mutilation and male circumcision. Oh yeah---the AIDS angle, too.

QuoteFeminist icon Alice Walker has bemoaned the horror of female genital mutilation (FGM) for years and acknowledged in a 2006 interview that Muslim scholars "have traditionally ignored the problem."

The author of the Pulitzer Prize-winning The Color Purple and Possessing the Secret of Joy – a novel that attacks the practice of FGM and the mythologies that sustain it – Walker told Feminist.com founder and executive director Marianne Schnall in December, 2006, that she had recently received word that "some scholars very high in the hierarchy of the Muslim world" had met in Cairo and resolved that "female genital mutilation is not to happen henceforth among Muslims."

Two developments in this case. The doctor's children and those of other cult members have been physically examined for signs of FMG. Here's a piece of good news in this.....

QuoteU.S. Magistrate Judge Elizabeth Stafford rejected the religious argument altogether, saying bond would be decided on the allegations, not religion.

"It is important to me ... to take religion out of it and focus on the allegations that young girls' genitals were mutilated and that the defendants played a role,"  said Stafford, noting the defense claim that the procedure isn't as harmful as the government claims isn't "persuasive."

"I think it's common knowledge that the cutting of the genitalia of a 7-year-old child would be painful,"  Stafford said. "I find this to be a serious crime."

...and the leader of their mosque has fled the country.

QuoteDetroit — A leader of the Muslim sect embroiled in an alleged female genital mutilation conspiracy boarded a one-way flight to India on April 10, the same day FBI agents raided a medical clinic where a doctor allegedly cut 7-year-old girls, The Detroit News has learned.

The flight is the latest development in a case that has led to criminal charges against one leader of the local Dawoodi Bohra community based out of a Farmington Hills mosque. Three members of the mosque have been charged in federal court with female genital mutilation and prosecutors say they belong to a religious and cultural community that practices the illegal procedure.

Two sources identified the leader as former mosque President Saifuddin Bhabrawala, whose three-year term ended before he flew from Detroit Metropolitan Airport on April 10, the day the genital mutilation scandal emerged publicly. He was detained by federal agents in conjunction with the female genital mutilation investigation and they searched his electronic devices before Bhabrawala flew to India, one source familiar with the man's trip told The News.

This was evidently an investigation taking months and far more work than first suggested. Cops had video cameras watching the clinic where these butchers did their work. Defense lawyers are failing to prove the defendants were NOT present at the scene of the crime on the days cops state.

This case reminds me of Doctor James C. Burt, rogue gynecologist
(if ever there were two words that should never be together...)
who thought he could enhance women's pleasure
by removing the flap of skin that normally covers the clitoris.

By leaving it exposed, it was made TOO sensitive, and painful.
He fraudulently obtained "consent" from the patients
by hiding in the fine print the surgery he was planning to actually do.

He surrendered his medical license to prevent an inquiry
that would have revealed many more details.
Lawsuits bankrupted him,
as well as the hospital where he performed the surgeries
(St Elizabeth Medical Center)
but he was never criminally charged.

So, Doctor Burt was trying to enhance sexual pleasure, but caused pain,
where Doctor Nagarwala was trying to eliminate sexual pleasure.
Doctor Burt's procedure was universally condemned,
where Doctor Nagarwala's procedure is endorsed by millions of Muslims.

Here's a short article about Doctor Burt:

Here's a longer one:

And here's a very informative one:

And here's some info about the horrifying practice:

https://en.wikipedia.org/wiki/Genital_modification_and_mutilation

The www.patient-safety.com article also informs us that:

Dr. Marci Bowers is skillful in this area
because of her experience with gender-reassignment surgery
in reconstructing victims of female genital mutilation in Africa.
She might be able to help Burt's victims put things back together.
She usually spends a lot of time in Africa helping to build a hospital,
but she is involved with  www.clitoraid.org,
a non-profit organization that helps with female genital mutilation.

More children of these cult members have been examined by doctors, and now authorities are seeking to take the kids into protective custody.

QuoteDetroit — Child welfare officials moved Friday to terminate the parental rights of as many as five families from a small Shia Muslim sect in Metro Detroit, alleging their children are victims of female genital mutilation, a lawyer said.

The initial moves could impact as many as 12 children from the families in Oakland and Wayne counties and sent waves of fear rippling across the local Dawoodi Bohra community.

Waves of fear? Let's escalate this to flee in mortal terror. The FMG abomination must end.

Well, so much for any crackdowns. The kids were allowed to remain with parents until this is settled.

QuoteReferee Scott Hamilton approved child protection petitions, which will go to Oakland Circuit Judge Victoria Valentine for a pretrial conference and possible decision. Child welfare officials are seeking to terminate the parental rights of several families from a small Shia Muslim sect in Metro Detroit, alleging their children are victims of female genital mutilation.

But Hamilton agreed with attorneys for the couples, state Health and Human Services workers investigating the families, and an assistant county prosecutor that the children from the two families involved in Tuesday's hearings do not appear "in any risk" at this time.

http://www.detroitnews.com/story/news/local/oakland-county/2017/05/09/genital-mutilation-parental-custody/101475892/

The risk is NOT over if these children were actually mutilated. Allowing them to remain with ignorant parents IS. They knew they were lawbreakers, else they would not have left the state to inflict this butchery on their own flesh and blood.

quiller

They're back, headed for court --- and it's a LEGAL RIGHT to mutilate your child, ask any Muslim...or their POS shyster lawyer.

QuoteOn paper, the law seems clear: Cutting any part of a young girl's genitalia is illegal — and no custom or ritual can be used to justify it.

The law has been on the books for 21 years, unchallenged.

But in a federal courtroom in Detroit, a landmark case involving the centuries-old taboo ritual is about to put that law to the test for the first time.

And perhaps more historic, a question will be raised in the American legal system that has never been raised before: Does the U.S. Constitution allow for genital cutting, even if it's just a minor nick or scraping, in the name of religion?

The Michigan Supreme Court is overwhelmingly conservative. Their decision seems inevitable.

The Ohio Supreme Court is all Republican, but over half are RINOs.
That was revealed in 2010
when the Court unlawfully kept a valid candidate off the ballot.
Then Secretary of State Jennifer Brunner (Dem) refused to count valid signatures
on a candidate's petition to run against Mike DeWine for Attorney General,
and the Court refused to hear the case in time to make any difference.

What this shows is, a Dem did a favor for RINOs
because RINOs are closer to Dems than they are to conservatives,
like the one who was kept off the ballot.
And the RINO court acted unlawfully to retain the favor.

I wrote about the whole thing at
http://www.cpnlive.com/forum/post/1924011
under the title "STOP ELECTION THEFT !!!"

(Follow up: Governor Kasich made it up to the candidate
a couple of years later  by appointing him to a state judgeship.
If I remember correctly, a State Appeals Court office came open,
and Kasich appointed the guy to fill the rest of the term.)
