People often confuse Vietnam with the term "police action," however, Congress did in fact authorize the use of military force in Vietnam in August 1964 which made Vietnam officially a war and not a "police action."  That was never true for Korea.

The fault for this constitutional failure falls on Congress.  They failed to exert their constitutional authority and allowed the President to usurp their power.  It was never put to a vote, only the congressional leaders were consulted and they gave Truman their tacit approval by doing nothing.
