U.S. District Judge Henry E. Autrey had issued a preliminary injunction in February prohibiting the town of Ellisville from prosecuting drivers who allegedly flashed their vehicles' head lights to warn of radar and speed traps. The city didn't appeal the decision.

Last week, Judge Autrey expanded that decision to a permanent injunction

Last week, an Oregon man, Chris Hill, fought a $260 ticket for improperly using his head lights while driving a truck full of logs. Hill won his legal fight, and Hill acted as his own attorney in the proceeding.

In May 2012, Ryan Kintner from Lake Mary, Florida, successfully fought a citation for violating a state traffic law by using head lights as a warning signal. The judge said the flashing was protected under the First Amendment

Whenever I go to do this I always end up squirting windshield washing fluid on my windshield instead of flashing my headlights. Fail.

You should think about a refresher course in driving.

  You should not drive at night then.  :glare:

Haha that reminds me. I was driving around at night in Las Vegas one time and everyone kept flashing me. I thought to myself "damn there must be cops everywhere...good thing these kind people keep warning me, because I don't see any cops anywhere..."

Nope. My dumbass forgot to turn my headlights on. The car I have now turns them on automatically so I got used to it I guess. That and the city was really bright.

A subaru is going to be my next car. Seems like a good middle ground between a commuter car and something that can tow things around like jon boats. Plus I heard they're decent cars. My wife says she thinks I'd look hot driving one (?) so that's a plus too.

I gotta tell ya, I totally disagree with ticketing someone who flashes headlights to get drivers to SLOW DOWN to avoid a citation.

The whole purpose of running radar is to get people to SLOW DOWN.

I usually turn my headlights on when I'm trying to turn on the wipers.  Guess I need a refresher course, too.

It's the second one I've purchased. This Forester was for Toy, I wanted to make sure she had a very dependable and safe car, as well as the ability to deal with snow.

Yep! But obviously that's not what the city had in mind, rather a source of revenue.

Cryptic Bert

I have always taken a rather skewiff view of this argument. The coppers will say that they sit there to slow drivers down. That is the ultimate goal right? Well if you see an oncoming car that flashes his lights what do you do? Job done. If it's all about safety why penalize those that succeed in slowing down the traffic? And it cost the taxpayers nothing...
