We had the same problem back in the 70s with Rose Bird and her refusal to follow the law, appointed by Brown, they turned to moonbeam, the same moron Gov we have today, and yes, some of these death row inmates were finally released to reactivate, though oddly enough google refuses to give names.

First a disclaimer: if the state law provides for the death penalty under certain circumstances in 1st degree murder cases, then it is incumbent on the prosecutor to pursue the death penalty when those cases arise, regardless of their personal opinions on the matter. If they do not, they should be fired.

That said, I am personally opposed to the death penalty for the basic reasons that A: Law enforcement is not perfect, even with the high end technologies available today, including DNA evidence and the like. and B: I have personally followed too many cases in which the prosecution was more politically motivated than justice motivated. Death is too final an option when there is even a minimal chance we could end up saying "OOPS!" a few years down the road.

THAT said, I am also very heavily in favor of revamping the penal system such that prisons are at least partially (MOSTLY) self sustaining. Why should we, the public, be forced to pay convicted criminals to play pool all day in pool facilities the rest of us would be paying $1.50/game or $5.00/hour to play? Why should the law abiding public pay for convicted criminals to work out in gyms that we pay $80/mo or more to join? And I will but mention cable TVs in all the cells except extreme high security facilities.

One of the purported purposes of the penal system is to rehabilitate criminals so they can be returned to society as productive citizens. And, admittedly, there is that small percentage who actually are capable of rehabilitation. SO - put them to work! Let them tend farming areas that produce a large portion of the produce they eat. Let them learn trades such as wood working and metal smithing, and sell the products on the open market. Those who work earn credit to pay for their food, clothing, laundry services, toiletries, etc, as law abiding citizens have to provide for themselves on a daily basis. And if they work HARD enough, then they can earn extras like cable TV, gyms and gaming rooms. The more prison life emulated the rest of society, the easier the transition for criminals who are released with terms served. (Parole and such - another topic...)

If they don't want to work, then they get the very, very basics: just enough nutrition to sustain life in its most basic form (beans and rice, unsalted, 3 times a day with a bowl of plain spinach at dinner - 7 days a week) a padded concrete platform to sleep on (no blankets or pillow) and a supervised walk around an empty room twice a day.

Revamp the penal system so the inmates actually have to put in some personal effort to sustain themselves, and then we would not have to worry about the costs of long term incarceration for those whose stay is "life without parole." Make the non-necessities something to strive for, just as the rest of society must do so prison is something to be avoided, rather than a mild inconvenience to be tolerated. Under those conditions, a life sentence without parole would be the worse option, rather than a needle in the arm.
