Q PATRIOT!!!

Sick Of Silence

He is not driving. Driving requires a license. No license is required to operate a lawn mower.
With all these lawyers with cameras on the street i'm shocked we have so much crime in the world.

There is constitutional law and there is law and order. This challenge to law and order is always the start to loosing our constitutional rights.

Frauditors are a waste of life.

It does if you're in the road.

He is trying to mow the grass. He is just missing because he is drunk.

Public intoxication. Case closed.

From what I gather, if you are mowing your private property, you safe for the most part. There might be open container laws, but I don't know too many riding mowers with cup holders.

Interesting:
http://www.wisconsinappeals.net/on-point-by-the-wisconsin-state-public-defender/a-riding-lawn-mower-is-a-motor-vehicle-for-purposes-of-owi-statute/

QuoteShoeder drove his riding mower on the paved shoulder of a city street, and was stopped and arrested for OWI in violation of § 346.63 after police were tipped off that Shoeder had an active warrant and was drinking in a tavern. (¶¶2-4). He moved to dismiss, arguing his riding mower is not a "motor vehicle" for purposes of § 346.63.

Sure, he acknowledges, a lawn mower meets the admittedly broad definition of "motor vehicle" under § 340.01(35) and (74)—any self-propelled device by which a person may be transported or drawn upon a highway. (¶¶10-11). But those statutes also say an "all-terrain vehicle" under § 340.01(2g) is generally not a motor vehicle, and, he claims, his lawn mower is really an ATV; thus, instead of being prosecuted under §§ 346.63 and 346.65, he should be prosecuted under the (comparatively more lenient) scheme that covers OWI with an ATV (§ 23.33(4c) and (13)(b)). (¶¶5-6, 8-9).

QuoteIs a lawnmower considered a motor vehicle? This question recently appeared before our Court of Appeals when considering the motor vehicle theft statute.

A couple recently had their Craftsman, gas-powered self-propelled riding lawnmower stolen near Leavenworth. The defendant was immediately caught and subsequently charged with Theft of a Motor Vehicle.

But the issue that came up was whether a riding lawnmower is considered a "vehicle" under this theft statute. It's clear that an item was in fact stolen, but was it legally considered a "vehicle"? The Court said no, it was not. The defendant could be charged with another theft crime, but under the applicable statute not of a "motor vehicle."

Don't know if there are different mowers for different states, but damn near all the riding mowers in Texas have a cup holder. Don't think they would sell without it.

Laws vary by state. Here in Ca, yes, driving a lawn mower on the street is illegal, as is many states.
Oklahoma makes it clear, they can arrest your ass if you get on a lawnmower drunk and hit public streets.

I got pulled over riding without my helmet in a parking lot, I said this is private property, he said so what...
I actually had this cop tell me if I was on my motorcycle on my own property and not wearing a helmet, he could arrest me.

I said you have my address, I dare you you to come out and try. The ticket was dismissed because I demanded a jury trial.
