Nice little CYA letter to the judge.


Oliver Schmidt, who is due to be sentenced this week in connection with the carmaker's emissions scandal, has written to the judge to say he feels "misused" by the German company.

Schmidt pleaded guilty in August in the U.S. District Court in Detroit to wrongdoing connected to a massive diesel emissions scandal that has cost Volkswagen as much as $30 billion. He is due to be sentenced on Dec. 6.

"I must say that I feel misused by my own company in the diesel scandal or 'Dieselgate'," Schmidt wrote to U.S. judge Sean Cox, according to a letter filed in federal court.

The letter was originally published by Germany's Bild am Sonntag newspaper.

A Volkswagen spokesman declined to comment, citing the ongoing proceedings.

Under a plea agreement, Schmidt faces up to seven years in prison and a fine of between $40,000 and $400,000 after admitting to conspiring to mislead U.S regulators and violating clean air laws.

In March, Volkswagen pleaded guilty to three felony counts under a plea agreement to resolve U.S. charges it installed secret software in vehicles to evade emissions tests.

U.S. prosecutors have charged eight current and former Volkswagen executives.

Schmidt was in charge of the company's environmental and engineering office in Auburn Hills, Michigan, until February 2015, where he oversaw emissions issues.

In the letter to the judge, he said he had agreed to follow a script, or talking points, agreed by Volkswagen management and a high-ranking lawyer, at a meeting with Alberto Ayala, a California Air Resources Board executive.

"In hindsight, I should never have agreed to meet with Dr Ayala on that day," he wrote.

"Or better yet, I should have gone to that meeting and ignored the instructions given to me and told Dr Ayala that there is a defeat device in the VW diesel engine vehicles and that VW had been cheating for almost a decade. I did not do that and that is why I find myself here today."

After being informed of the existence of the emissions software in the summer of 2015, according to his guilty plea, Schmidt conspired with other executives to avoid disclosing "intentional cheating" by the automaker in a bid to seek regulatory approval for its model 2016 VW 2 liter diesels.

Now it wouldn't matter if the regulations were loosened, they still got the guy on conspiracy.

Every so often, I see some truck running down the highway, obviously burning fuel oil or off-road diesel, by the huge plume of black smoke.
I've heard it's a $1000 fine for the driver, or $10 per gallon... what an easy way for the hwy patrol to meet a quota.
All animals are created equal; Some just take longer to cook.   Survival is keeping an eye on those around you...

Hmmm, if he's smoking? He changed out his chip and doesn't have to deal with the new catalytic converters. Today's red dye diesel is exactly the same as clear diesel, the only difference, is the red laced chemical designed for Federal sniffers on the Hwy to catch you skirting taxes via the pump.
But no, the fuels are identical to one another.
The secret, stay off Highways, stick to only backroads, and they'll never catch you.

What V-Dub got nailed for was allowing the cars computer to trick EPA sensors when it went in for a smog check by going into a different mode, one no driver could accomplish on their own.
Quite ingenious if you ask me. :biggrin:

Around here, there's plenty of that high sulfur stuff to burn up - and they are... on the main roads, smaller highways.  We'll get a standby generator topped off, and you can tell pretty quick if they used the ultra-low sulfur diesel or the old stuff.

It's been outlawed in most states for nearly a decade, but some people can still get the old heating oil, basically diesel fuel with the sulfur still in it.
Here in Ca, we haven't seen it in a decade, even heating oil is the new low sulfur shit.

Wasn't there an air injection system on cars in the '80s that did essentially the same thing, dilute the exhaust?

Got me, though it does ring a bell, I only know about turbocharged diesels.
If I move to Idaho, that catalytic system is coming off, gain 3 miles per gal, plus 25% power increase, then switch out the chip for twice that amount, I'm good..

Nine second quarter @ 140 mph plus rocks.

Hmmmm.......  just bought Wifey a 2017 Nissian Diesel Titan XD. (twin turbos on a Cummings)  She loves it.   First thing she said was, "Wow, this thing has POWER!"   I thought a RAM HEMI 1500 (gas) had power, nope, not like this.  Low end torque that can relocate you into the back seat from a stop light.  Still breaking it in, MPG is steadily going up... was 8mpg, now 17mpg average from mile 0 (hasn't reset it yet, probably closer to 20-22mpg).

I thought a Subaru Forester was fun off-road, on the beach, this Titan ... if she'll let me drive it... is gonna be fun-fun-fun!

Nissan is putting Cummins in their trucks? That's downright Badass! :thumbup:
My Dodge 3500 now has 25 thousand miles, it doesn't even reach break in till 50K when my mileage should finally reach 20 plus miles per gallon.
One thing about Cummins diesel, drive it like you stole it, they hate being babied, they'll throw fits if you lug around all day.
If I baby it, I get 17 per gallon, if I floor it everywhere I go, I get 15, and I live in rugged country to boot.
Kick its ass, it'll love you for it. :laugh:

Right now my Dodge Ram 03 2500 Cummins diesel is averaging just over 23 mpg and it has 257.000 + miles on it.   I change oil ever 3,000 miles and transmission oil every 30.000

From what I've read elsewhere...
Toyota and Nissan are using the same Cummings engine & drive train for their bigger trucks.   Those twin turbos make a pleasant whistle spinning up ... "We're ready, let's get going!"



Quoten the Nissan, it'll be paired with a six-speed automatic transmission sourced from Aisin. The engine's output is a stated 310 hp and 555 lb-ft of torque, which Nissan says gives the Titan XD the ability to haul a payload of 2,000 lbs and tow over 12,000 lbs. Fuel economy figures haven't been released, but Nissan is projecting "20 percent better fuel economy than a gasoline-powered V8 while towing full loads."

We waited till this time of the year to get the price down to clearance levels.  $45k reduced to $34... and knock off a bunch more for trade ins, 2 for 1 vehicle.   Reduced our insurance $60 a month too!    Need to get it undercoated so it stays around a long time.

What I like most about the turbo Cummins, is the constant power/torque range up to around 90Mph when it starts topping out.
From the moment you floor it, it sets you back throughout the shift process.
I can load up the bed with a couple of thousand lbs, and the only difference, is it rides smoother, but the pull stays the same.
I tend to carry 500 Lbs of stuff in the back, just to keep it more comfortable to ride in.
